1. Scope and relationship to other terms
These Terms supplement the Frameleaf Master Terms of Service between you and Frameleaf, Inc., a Wyoming corporation, for the offered cloud description, upscaling, restoration, interpolation, transcription and other expressly enabled media-processing jobs, GPU computation and related AI wallet credit (AI Services). They do not govern an independently operated local model merely because it is used with Frameleaf Library. The Privacy Notice, Security, Retention and Deletion Schedule, Acceptable Use Policy and, where applicable, Data Processing Addendum also apply. The Subscription, Billing and Refund Terms govern monetary charges and marketplace purchases.
An AI feature, model, resolution, processing mode or accelerator is included only where actually offered and selected. Advertising an integration or showing a demonstration does not promise a particular third-party model will remain available indefinitely. Existing paid commitments and accepted jobs remain subject to the protections below.
2. Selecting content and authorizing cloud processing
2.1 Separate authorization
Enabling encrypted backup or remote relay does not, by itself, authorize cloud AI analysis of your library. Before starting an AI job, Frameleaf will identify the selected content or selection rule, requested operation, applicable credit quote or usage formula, processing destination or provider category, material retention terms and whether processing requires access to unencrypted content. A continuing automated rule must be separately enabled and may be disabled for future jobs.
An administrator may authorize a rule only within the authority they have over the affected content and users. A rule for an entire library must clearly identify that scope and its effect on future additions. The rule does not eliminate the need for a lawful basis and any required consent from depicted people.
2.2 Inputs and encryption boundary
Cloud AI requires readable inputs at the processing system. Description jobs use prepared previews with embedded location and device metadata removed. Media-enhancement jobs can use a crop or clip for a preview and a prepared full image or video for a full render; audio jobs use the selected audio content. A statement that every job sends only a small thumbnail would not describe these operations. Removing embedded metadata does not remove information visible in an image, audible in a recording or written in a prompt.
The Library prepares the inputs and submits the authorized job to its selected processing destination. Local or independently configured processing is separate from Frameleaf Cloud processing. Face detection and face recognition remain on the Library’s configured local or customer-operated machine-learning service; they are not cloud face-matching services. Optional identity naming and medical-signal description controls are separate from biometric recognition.
Job transport and temporary storage are protected, but the job is not end-to-end encrypted against its authorized processing system. Cloud job keys are service-managed and are different from your customer-held backup key. Buying credit or enabling backup does not authorize access to an unrelated backup archive.
2.3 Sensitive inputs
Do not submit content without the rights and authority needed for the requested processing. Facial identification, biometric templates, precise locations, medical material, intimate images and children’s information require particular care and may be disabled or restricted in certain regions. The Biometric and Sensitive Features Notice applies where such functionality is offered. Permission to store a photograph does not necessarily establish permission to identify everyone shown in it, recreate a person’s likeness or submit the photograph to an external model.
3. Job specifications and processing
A job specification identifies the offered operation, prepared inputs and settings, with a cost estimate and reservation under Section 8. An estimated range is not a fixed-price quote. A preview and a subsequent full render are distinct processing stages and may incur separate disclosed charges. Estimates are not guaranteed completion times. Resource availability, queue depth, provider failures, unusual media formats and safety screening may affect completion.
Frameleaf may reject unsupported jobs, enforce disclosed technical limits, or refuse prohibited content. It will not intentionally substitute a materially different processing provider, privacy boundary or higher-priced operation without renewed authorization. A technically equivalent infrastructure change that does not materially change those matters is subject to the applicable subprocessor and security commitments.
You may cancel a queued job without a compute charge where resource use has not begun. After processing starts, cancellation may stop future work but may not reverse resources already consumed. The interface must explain the applicable cancellation charge before submission. Automatic retries caused solely by Frameleaf or its processing infrastructure failing the accepted job are not separately charged unless you expressly authorize a new, distinct operation.
4. Ownership and permitted use
You retain your rights in inputs. You grant Frameleaf and its authorized processing subcontractors only the rights reasonably necessary to perform your requested job, return results, maintain security, address support requests and comply with law, subject to the limited content license in the Master Terms. Subcontractor rights must be limited consistently with that purpose.
As between you and Frameleaf, and to the extent permitted by law, Frameleaf assigns to you any transferable intellectual-property rights it acquires in outputs generated specifically for you, excluding Frameleaf’s pre-existing technology, models, software and third-party materials. Where an expressly disclosed model license limits use or redistribution of outputs, those material limitations must be presented before the job is accepted; a newly introduced restriction is not applied retroactively to completed outputs. Model weights and the processing system are not licensed to you merely because you receive an output.
This allocation does not establish that an output is protected by copyright, is unique, is non-infringing, or contains no third-party rights. Other users may receive similar results. You remain responsible for permission to publish a person’s image, likeness or voice and for any applicable disclosure that media is synthetic or materially altered.
5. Training, human access and service improvement
Frameleaf will not use private inputs, private outputs, face templates or private library metadata to train a generalized or cross-customer model, nor authorize a processing subcontractor to do so, as part of ordinary AI Services. Fine-tuning or adaptation requested specifically for your private account must be separately described and authorized and is not permission to reuse that material across other customers.
Any future optional contribution or training program requires a distinct explanation of the data, recipients, purpose, retention, withdrawal consequences and rights that can lawfully be granted. Declining that optional program will not disable paid features that do not require it. The acceptance of these Terms is not consent on behalf of every person depicted in a library.
Human access to readable job content will be limited to authorized personnel where reasonably necessary for a support request you initiate, investigating a specific security or abuse issue, a legally required action, or another separately authorized purpose. We will not routinely have staff browse private photo libraries to evaluate model quality. We may use minimized operational measures, such as latency, failure categories, resource consumption and non-content usage counts, to improve reliability without creating a training corpus of private media.
6. Accuracy and unsuitable uses
Outputs can be erroneous, fabricated, biased, incomplete, offensive or inconsistent. Enhancements may invent detail, change identity or remove important information. Scene descriptions, inferred identity names, timestamps, object identification and location guesses are suggestions, not verified facts. Local face matches likewise are not verified identity findings. Preserve originals and review outputs before applying edits or organizational actions.
Do not rely on AI outputs as the sole basis for medical, legal, financial, employment, education, insurance, law-enforcement or other consequential decisions about a person. The Services are not designed for emergency response, autonomous safety-critical operation or forensic authentication. This limitation does not prohibit a lawful professional from using permitted features as an ancillary tool with appropriate independent review.
An AI suggestion to delete, merge or replace content is not an instruction to do so. A destructive workflow requires your separate confirmation, or an explicitly enabled automation rule that describes the consequence and available undo or retention protection. Frameleaf will not describe a generated reconstruction as an unchanged original.
7. AI wallet and purchasing
AI Credits are the USD-denominated prepaid balance in your Frameleaf Cloud AI wallet. They pay for eligible Cloud processing jobs and are bound to the purchasing account. They do not earn interest, cannot be transferred, sold or gifted to another account, and cannot pay a storage subscription or an unrelated third party. They are not a bank deposit or a general-purpose payment account. Applicable prepaid-value, consumer, tax and unclaimed-property laws still apply.
The purchase screen identifies the amount, currency, taxes and transaction limits. A top-up adds the purchased USD value. Ordinary Cloud subscriptions and Library licences do not include AI wallet credit or a discount on GPU usage unless an express offer states otherwise. Separate promotional credit or credit notes, where issued, are identified in the ledger with their applicable conditions.
The standard purchased-credit expiry is 12 months from purchase, where permitted by applicable law and disclosed for the purchase. The service sends an expiry warning 30 days in advance. Where mandatory law prohibits expiry or requires a longer period, that rule prevails; an account’s technical region setting does not determine its consumer-law rights. Promotional expiry follows the disclosed offer. Expiry affects the service-use balance; it does not extinguish the right to a refund of unused purchased value under the Refund Policy. Closing an account does not itself stop an otherwise applicable expiry clock.
8. Estimates, reservations and charges
Jobs are charged using metered GPU time at the accepted compute rate, together with disclosed worker-start fees. Per-photo, per-minute and estimated total figures are estimates. The job’s accepted rate is not increased retrospectively because a later price is published.
Before starting, the service reserves wallet value using the upper estimate and the applicable safety margin. Reserved funds cannot fund another job, but have not yet been finally spent. A running job’s reservation may be extended from the available balance under the accepted metered-pricing arrangement and account spending controls. The first reservation is therefore not an absolute final-price ceiling unless the particular job expressly offers one.
The processing budget limits continued computation. If sufficient budget is unavailable, the job may stop at a safe boundary rather than complete. On settlement, actual eligible usage and start fees are charged within the funded reservation; any service-funded grace amount is absorbed by Frameleaf. Unused held funds are released. A partial or canceled operation can have consumed billable resources under its disclosed cancellation terms.
The wallet records funding, holds, captures, releases, adjustments, expiry and refunds. Purchased funding lots are accounted for in purchase order; separately issued promotional value follows its ledger rules. The account’s daily spending, balance and concurrency controls do not guarantee GPU availability or a completion time.
Automatic top-up is optional. You choose its threshold, amount, funding method and monthly cap and can disable future automatic purchases. It is separate from authorizing a particular job. A top-up failure, dispute, wallet freeze, account restriction or deletion request can prevent replenishment and new processing. Frameleaf will correct duplicate or erroneous debits and will not deliberately split a job to evade an expressly applicable cap.
9. Failed, refused and unsatisfactory jobs
We will release reservations or restore credits for a job rejected before meaningful processing, a duplicate charge, a job that fails solely because of Frameleaf’s or its selected infrastructure’s error, or a completed operation that produces no usable deliverable because of such an error. Deliberately submitting unsupported or prohibited material is not a means of obtaining unlimited free computation, but any charge for materially consumed resources must have been disclosed in advance.
Subjective dissatisfaction alone does not guarantee a refund where the correctly described operation was performed and delivered. This does not exclude remedies for a material defect, misdescription, undisclosed substitution or mandatory consumer guarantee. Report an issue through [email protected] with the job identifier; do not send private source media unless specifically needed and authorized.
10. Refunds, closure and deletion
Unused purchased AI credit is refundable on request under the Refund Policy. The refundable amount is the unused paid value after legitimate settled usage, prior refunds and reversed payments. Free promotional value is not cash-refundable. Frameleaf does not deduct an administration fee or the original payment-processing fee from the eligible refund.
You may request a refund through the account’s available controls or [email protected]. A pending job may need to settle before the unused reservation can be released and refunded. Refunds normally return through the original payment channel; marketplace purchases follow the relevant marketplace process. Correctly consumed credit is not unused, but failed-job and billing-error remedies remain available.
Canceling a subscription does not itself request a wallet refund. Closing an account can prevent sign-in, and erasure can remove the service-use balance, but neither action nor expiry extinguishes a claim for the corresponding unused purchased value. Support will use the retained transaction and usage records to resolve that claim when self-service access is unavailable. There is no separate contractual refund-request deadline, subject to applicable legal limitation and unclaimed-property rules.
Requesting account deletion starts the cancellation period described in the Security Schedule and stops new top-ups. Arrange refunds before erasure where possible. Deletion is not itself an automatic refund request and does not eliminate the refund right. An unresolved refund request or an approved refund still processing can delay erasure as described in that Schedule.
If Frameleaf discontinues the services for which purchased credit can be used or terminates access, the unused purchased value remains refundable. The Refund Policy controls any inconsistent standard term about that refundability. Mandatory legal rights remain unaffected.
11. Retention, delivery and access
Selected AI content is uploaded directly to an ephemeral processing worker. Uploaded content and container-local working data are deleted immediately when the job finishes, and the processing container is destroyed. Frameleaf does not retain a stopped container or a separate post-job upload archive. The destroyed container and its uploaded content cannot be recovered through the service.
There is no 24-hour post-job retention or retrieval window for uploaded content. A result must be received through the supported delivery process; a disconnected Library may miss delivery. Processing is not a backup service, and Frameleaf cannot retrieve uploaded content from a completed job.
A delivered result saved in your Library is controlled by that Library. Preserve the original and inspect the result before publishing or applying it. A result separately captured by a backup follows that backup’s lifecycle. The job ledger can retain operation, usage and charge records after media is removed.
Revoking consent stops future consent-based processing and does not undo a completed output already downloaded or distributed. Deletion and incident handling follow the Security Schedule and Privacy Notice.
